How Much Is a Wrongful Termination Case Worth?
August 2, 2026 · Employment Litigation
General education for California employees—not legal advice. Your facts and deadlines control. This is not a Workplace Rights Advocacy case result.
The short answer
It depends. A wrongful termination case might resolve for a modest five figures—or much more—based on lost earnings, emotional distress, available penalties or punitive damages, attorney’s fees exposure, and how strong liability looks. Damages categories that drive value
- Economic losses: back pay, benefits, sometimes front pay or reinstatement value
- Emotional distress: common in FEHA and related tort theories when supported
- Punitive damages: for especially egregious employer conduct when the standard is met
- Statutory penalties / fees: depending on the claims pled

What usually raises or lowers settlement value
Strong documents, clear retaliation timing, high lost wages, and a trial-ready posture tend to increase leverage. Weak liability, failure to mitigate (for example, refusing comparable work without good reason), or major credibility problems cut the other way. Mediation numbers also reflect litigation cost and risk for both sides—see mediation and timelines.
