Am I Owed Overtime If I Am Salaried in California?
August 2, 2026 · Wage & Hour
General education for California employees—not legal advice. Your facts and deadlines control. This is not a Workplace Rights Advocacy case result.
The short answer
Often, yes—you may still be owed overtime if you were misclassified as exempt. California exemptions turn on actual job duties and salary tests, not the word “salary” on a pay stub.

Red flags for misclassification
- You punch a clock or have little real discretion
- Your title is “manager” but you mostly do production work
- You were told you are exempt because you are paid a salary
- You regularly work long days without premium pay
Related claims
Misclassification often pairs with meal and rest break premiums and misclassification theories—including independent-contractor labels.
