Was I Misclassified as an Independent Contractor?
August 2, 2026 · Wage & Hour
General education for California employees—not legal advice. Your facts and deadlines control. This is not a Workplace Rights Advocacy case result.
The short answer
Maybe. California’s tests—often including the ABC framework for many workers—ask whether you were truly running an independent business. Labels on a contract do not control. See independent contractor misclassification and misclassification.
Practical red flags
- The company set your hours, tools, and methods
- You could not realistically work for others
- You were integrated into the core business
- You were paid like staff but denied overtime and breaks
What you might recover
Unpaid overtime, break premiums, expense reimbursement, and related penalties—depending on the facts. Compare also salaried-exempt misclassification in our overtime article.
